Should I get a divorce 5 questions to ask before you do it The New York Times has an 11-point list of questions to ask yourself to see if youve done everything you can to save your marriage. I coach a lot of people who are thinking about getting a divorce. Almost everyone feels that their spouse is impossible, unresponsive, and/or doesnt care about the issues at hand. The biggest problem with divorce is that people who struggle with money divorce the most, but people who dont struggle with money are the people who have a better life after divorce; and its almost always the men  in one way or another. So whats the best way to know if youll benefit from divorce? Think about divorce in terms of what life will be like after the divorce. Because the reasons divorce is a bad idea, besides being terrible for the kids, is that unless you are a high earner, you have little ability to control what happens after divorce. When you imagine your life after divorce, consider these things: 1. Your standard of living will plummet.  The person who earns the money will have to give up half in order to keep both parents at the same income bracket. That is what the courts order. If you are the breadwinner in the marriage, you will be supporting your ex (and their new significant other) in a new house. And if you are the non-breadwinner of the marriage, your income will plummet, and you will probably have to get a job (and trust me, the   jobs you can do while your kids are in school are awful.) 2. You will lose your kids 50% of the time. Just like you shouldnt bet your money unless you can afford to lose it, you shouldnt ask for a divorce unless you can handle losing your kids for 50% of the time. Your spouse will likely ask for more and more time with the kids. It may be because of social pressure, or to make your life miserable, or because the spouse really wants the kids, but regardless of motivation, courts generally give 50% time to each parent if they want it. Even after the parent has abused the kids. 3. You will lose your friends. All the friends you have who are couples will fall off the radar. Its not on purpose. But people like to be friends with people who are like them. And now you have a whole new set of issues to deal with. None of which are trying to make a marriage work. Also, people are friends with people in their income bracket, and after a divorce you end up in a completely new socioeconomic arena. Also, its hard to be friends with people who have kids when you are single 50% of the time. And its hard to be friends with single people because you have kids. 4. Your spouse will remarry and the new spouse will care for your kids. You might not like how your current spouse takes care of your kids, but at least you have influence. Your spouse can remarry, and give your kids to their new spouse to raise for 50% of the time. There is nothing illegal about that, and your kids will put up with it because kids want to see their parents. 5. Divorce agreements are not enforceable. I mean, they are, but you have to go to court each time. With a lawyer. That costs time and money, and in the meantime, you are in limbo. So only rich people enforce divorce agreements. Other people deal with the fact that their spouse is doing what they want, not what is in the agreement. So instead of assuming you will get court orders for everything, assume you will negotiate with your spouse every week until your kids are out of college. Exceptionalism may be your biggest problem I have found that most people considering divorce do a lot of research but they suffer from exceptionalism. They think their partner is more terrible, or more impossible, or more uncaring about the kids than the typical spouse. But its statistically unlikely that your spouse is that different from every other spouse, and statistically you likely have confirmation bias. Unless you want to give up your kids when you give up your marriage, you will always be involved very closely with the other parent of your kids. And you will have less control over that involvement after a divorce. A better solution than divorce is understanding why you chose to have kids with that person in the first place. The more you understand your own impulses the more you can manage yourself from inside the marriage, and that will make a good deal of difference. People who have good impulse control do better in life than everyone else. Heres the research. And divorce is a great example of this. If you stay married you will be better off in the long run.

Calculating Lost Income for a Personal Injury Claim If your career has been put on pause due to a  truck accident injury, or another serious injury caused by the negligence of others, don’t let the resultant loss of income affect your income. If you talk to an LA injury attorney, you will find that besides medical expenses and pain and suffering, your claim can also include significant loss of income compensation. But California personal injury laws governing how to calculate loss of income can be complex. Here is what you need to know: 1. All lost income must be documented In the legal world, say-so statements are void. That is especially true when you are dealing with a potentially antagonistic at-fault party and/or insurance company. You will need documentation proving that you have/had a medical condition that prevented you from working as usual, and you must be able to prove the connection between the accident, the injury, and your loss of income. Gather the doctor’s note showing the nature of your injury and how long you suffered from it, recent pay stubs showing your normal level of income, tax returns for the previous year or more, and a letter from your employer (if you aren’t self-employed) confirming your employment status and pay rate. 2. Choose between the hourly wage and the annual salary calculation method For an hourly wage, calculation is fairly straightforward: just multiply lost hours per day by your hourly wage, then multiply that by the number of days missed at work. $15 per hour times 8 hours equals $120, multiplied by 100 days hospitalized or in rehab, equals $12,000. But some who are not paid by the hour need to use an alternate loss of income calculation method. Divide your annual income by your number of annual work-hours (2,080 if you work five days a week full-time). Then multiply by the number of days missed due to the injury. 3. Don’t forget to include ALL sources of income Don’t overlook overtime pay rates and hours, bonuses you missed out on, promotions you would likely have gotten but didn’t (for longer-term calculations), and other sources of income you had but lost or could reasonably be expected to have obtained but didn’t because of the injury. A good injury lawyer can help you wade through all these “loose ends” and substantially increase your loss of income claim. 4. Don’t “cheat yourself” because you are self-employed Special care will be needed to correctly calculate all of your lost income (“income” not “wages”) if you are a sole proprietor or the head of your own small business. Your business records, 1099s, receipts from past clients, and a host of other documentation may be of assistance here. You will need a good accountant and a good lawyer to ensure you don’t miss anything.  But be advised, if you did not report prior income for tax purposes, you can’t suddenly report it now for the claim. 5. You may be entitled to compensation for future lost income as well In cases where it is determined you suffered from lost earning capacity, you can likely collect compensation for the income you would have made in the future but now won’t (besides for past lost income). Your age, skill sets, education level, and other factors will come into play here. You will need a “forensic economist” to help you out.  But your personal injury attorney will know how to find one for you. How to Lose a Candidate in 10 Days Have you ever wondered what it is that annoys candidates the most about dealing with recruiters? There are a number of things you can do to test a candidates patience think  Kate Hudson crazy in How To Lose A Guy In 10 Days. Over the 10 days make sure you introduce them to your split personality, turning commitment levels from 0 to 100 intermittently, depending on their application status. To really  get under a candidates skin, all you have to do is follow this 10-day plan. (Candidates, maybe you can also relate.) Day  1:  Call a candidate with no agenda Maybe youre new to recruitment or simply low on your call times. Try calling a candidate with no agenda, get them to step outside their office for at least five minutes while you watch the seconds tick away and ask them about salary requirements, their previous managers, applications and any other fishing you can do! When the candidate asks about the opportunity you have in mind bluntly tell them that you dont have one, just keen to find out in case something comes up. Once youre done, if you really want to test the candidate you can transfer them to your colleague  who you sit next to in the office (and repeat process). Day  2: Keep them guessing When the candidate calls in to check whether the advert is describing a company which theyve already applied to, enter into a Mexican stand off with them and firmly tell them that they can only know the company name if they tell you the company name by process of elimination. If they dont want to agree to this then assure them that the only way for them to find out is for you to submit their application and let them know if it comes back as a duplication. Day  3: Go hot and cold like theres no tomorrow Make sure you  alter the amount of contact and pressure you put on the candidate based on whether it is you or the candidate who is required to complete a task. When you first realise that they could be a good fit for an open role make them feel like the world could end if they dont leave work to go to a library and email over their CV within the hour. As soon as you have their CV you can take your foot off the pedal and if they chase feedback make them feel as if  theyre being clingy, assure them that you have other important things to do and will get back when/if you get feedback! Day  4: When they call in, get your colleague to say  that youre in a meeting Still not got that feedback from the client? You basically asked the candidate to book days off from work the following week, assuring them that you would get them an interview slot. You assured them that, as its an urgent role you needed the commitment for interview and that youd sort the rest. Its the Friday afternoon and you told the candidate to book off the following Tuesday theyre calling in and as your colleague calls out the candidates name it reminds you that you havent chased up the client (Oops!). Swerve that call, having your colleague tell them that youre in a meeting is usually believable. Day  5: Tell the candidate a different salary Youve had a look at the candidates CV and you dont think the client will pay above a certain salary for the candidates experience, beat them down on their salary requirement which is lower than they are  looking for. Assure them that this is the absolute maximum for the client. Get off the phone to the candidate and immediately send out a blanket email to candidates on the database advertising the role above the discussed salary. Day  6: Dont call me, Ill call you They sent you their CV to you months ago but there wasnt anything open at the time which led to a number of ditched calls and lost emails. Now that theres a live job, by lunchtime youve managed to call them, their partner and their company to let them know! Day  7: Presentation prep, what presentation? As they call in after  their interview to tell you how it went, act surprised when they tell you that they werent aware that they were supposed to be doing a presentation, or maybe they were late as they went to the wrong company building (oops!). Plead ignorance, if they question too intensely about this tell them that you have another call and youll have to pop them a call back when youre free. Day  8: Oversell the job Tell the candidate that, whilst it may not be the salary or even close to the type of job they told you they are looking for,  definitely emphasise they will be working on cutting edge, world leading stuff that definitely matches their profile. Vouch for the office  location (even though youve not been there yet the manager told you its nice, though). Short contract? Tell them theres a 99% chance the company will keep them on even if you have no clue! Let the candidate take the day off work and sit back as they experience the disappointment for themselves! Day  9: Book that much needed spa day on the day of the candidates interview Youve had a difficult week, treat yourself and book in a nice RR day for the day of the candidates interview. In your excitement forget to mention this to the candidate so if they call in flustered about directions 5 minutes before the interview it will take at least 5 minutes for them to track down a colleague who is of any use! Day  10: They didnt get the job? No need to get in contact then No one likes to be the bearer of bad news, Im sure the candidate will forget about it if you just dont get back to them anyway. If they chase it up you can always dodge the call and send them a template email saying that you tried to call to give feedback but couldnt get through, just a one liner saying they were unsuccessful will be fine! Guilty of the above? Hey, no ones perfect but dont expect a Christmas card from said candidate/s next year!

Five Little Secrets About Networking Networking isnt about looking for a job.   The truth is networking is a way of life. It is about making new friends and developing trust! Whether you a college graduate or seasoned executive, it is never too early or to late to start.   Here are five things to help you understand the real meaning of networking. 1. BE OTHER CENTRIC Networking is not about spewing your 45 second commercial. It is about meeting people and developing a relationship.   Always show interest in others.   Ask them what they do and really listen to their answer.   Even ask sincere follow-up questions. 2. GATHER INFORMATION The time to start gathering information is while you are employed. Speak with co-workers and peers about what they are doing, what they find interesting and listen. Listening is a key ingredient to being a good networker. Ignore that voice in your head that wants to weed out information or discard it.   All information is good information! 3. TRACK MOVERS AND SHAKERS Carve time into your schedule to meet industry movers and shakers.   Read their work, follow their activities.   See what makes them tick. 4.   MAKE IT FUN Every time you leave your house you have the opportunity to meet new people.   Consider it a personal challenge or game, because you just never know what may happen or who knows who.   The next time you go to fill up your car with gas, pay inside and chat with the cashier, just for a second.   Doing this is great practice at making small talk and again, you just never know.   Maybe it is the dry cleaner, supermarket check out or coffee shop barristaall of these folks are great practice and worthy of becoming new acquaintances. 5.   LATHER RINSE REPEAT Just as the instructions say on a shampoo bottle (or used to) networking is an on-going process. Meeting someone once does not form a relationship.   You need to continuously make the effort to re-connect with them.   It can be as simple as sharing an article or sending them a quick note about an upcoming event they may be interested in or a message asking them about a project they said they were working on.   Listening is important.   It will be very difficult to do this follow-up if you havent been listening to what theyve talk about. FINAL NOTE: Greater than 80% of jobs are secured through some form of networking contact.   If you feel this sounds like a game, ignore that voice in your head.   Approach networking as information gathering and an opportunity to meet new people. There is no hidden agenda there. Be patient.   Networking takes time and so does establishing trust.   This is not a wonder drug that will promise immediate results.   This is an investment in your future.   Networking is about establishing relationships and it is a quality vs. quantity mentality that will best serve you.
